Resultant lunacies

Many books and an immense acreage of newsprint have been devoted to the appalling but inevitable consequences of laws passed by remote bureaucrats.  The dreadful years of the Soviet Union are a chilling example but the EU SYSTEM is running a close second.

This system is made infinitely worse by the implosion to apply laws indiscriminately to a huge and diverse continent of nations all speaking different languages.

Add to this the turgid gobblegook in which so many of them are drafted and their dreary length.

A large proportion of the problems arise from or come under the heading of

"the law of unexpected consequences"

due to the EU Commission's touching belief that

"one law will cover all complexities of life on a continent of several million people.

In addition, DIRECTIVES are often gold-plated by our own home grown bureaucrats in WHITEHALL if ONLY to JUSTIFY their EXISTENCE, which make their effect even more ONEROUS.

by Booker and North identified the six point sequence where, in their words, the machine goes off the rails.

These were:

1      The EU factor and the flood of DIRECTIVES from BRUSSELS which you are beginning to be familiar with having got this far.2     

2      The WHITEHALL effect, when the regulations were put into BRITISH LAW often making them FAR MORE DAMAGING.

3      HOME -MADE regulatory law as a result of EU DIRECTIVES such as the CHILDREN ACT 1989.

4      The enforcing of guidance on EU LAW as if it was ACTUAL LAW and which was in fact BEYOND the LAW.

5     Overzealous enforcement and puritanical AGGRESSIVE ZEAL with which OFFICIALS treat the PUBLIC.

6      The resultant CLIMATE of FEAR and CONFUSION with the mass of  NEW EU REGULATIONS and the increase in OFFICIAL POWERS making people AFRAID to CHALLENGE officials or their DEMANDS.

Getting back to the root cause of it all, EU DIRECTIVES can be subdivided into a number of categories. Many are, if one is feeling charitable, well-intentioned but IT IS the RESULT we are CONCERNED WITH.

let us bear in mind the well-known saying. at least well-known to your grandfather's generation and

"the road to hell being paved with good intentions"

and stop feeling charitable. many of the examples are the work of the sterling Messrs Booker and North which at least ensures the jobs of a number of

BRUSSELS BUREAUCRATS

employed in sticking pins in their effigys.

1  Those laws which put huge unnecessary costs on thriving businesses which often make it impossible for

IMPOSSIBLE THEM TO SURVIVE

of which there are some THOUSANDS.

2      Those which make life for the ordinary citizen more irritating and, as a bonus, add to the

CONTROL of OFFICIALS    

over OUR LIVES.

3      The DIRECTIVES which impose MONSTROUS COSTS on the WHOLE COUNTRY and thus THE TAXPAYER, often running into BILLIONS of POUNDS STERLING.

4      LAWS where they PROHIBIT or DESTROY -ANCIENT and HARMLESS CUSTOMS, often involving SOCIAL and POLITICAL ENGINEERING.

5      The completely LUNATIC

6      The possibly WELL-INTENTIONED in a BLUNDERING sort of way but SUBJECT to the LAW of UNEXPECTED CONSEQUENCES.

In the words of Vladimir Bukovsky, a Russian dissident of many years of bitter experience,

"...the results of what they are trying to do in Europe will be the EXACT OPPOSITE of what THEY PROMISE. This always happens with SOCIALIST UTOPIAS, they ignore HUMAN NATURE, they want to change it and when it BOUNCES BACK they are ALL SURPRISED"

The huge regulatory explosion which now afflicts us originated in large part from

PUT INTO LAW BECAUSE WE HAD TO IMPLEMENT VARIOUS EU DIRECTIVES

The Health and Safety at Work etc Act 1974

The Financial Services Act, 1986

The Children Act 1989

The Community Care Act 1990

The Environment protection Act 1990

The Food and Safety Act 1990

The Fresh Meat Regulations (Hygiene and Inspection) 1992

The Vehicle Excise Duty (Reduced Pollusion) (Amendment)

The Data protection Act

Control of Asbestos at Work

Disability Discrimination (Providers of Services)

(Adjustments from 1999 0f Premises) Regulations 2004.

[The LIST is ENDLESS we can go on and on and on and we would still not get to the end  because it will NEVER STOP.]

Each of these ACTS subsequently gave BIRTH to a MASS of subsidiary regulations implementing further EEC/EU DIRECTIVES and THIS IS ONGOING.   To take just one example the

Animal by-products REGULATION 2003 which came from

EU REGULATION 1774/2002

puts more than

500

NEW CRIMINAL OFFENCES

on the

STATUTE BOOK

[More lucrative business for the legal profession]

Each punishable by a FINE of up to

£20,000

or

TWO YEARS

in

PRISON.

My favourite example of officialdom is the visit of a Health and Safety officer to a Welsh farm show who insisted that a completely open tented lean-to

MUST HAVE A FIRE DOOR.

This came under

CATEGORY 5

and when I analyzed some of the thousands of EXAMPLES of EU DIRECTIVES and their RESULTS, surprise, surprise,

CATEGORY 5

came out

WAY AHEAD.

For this reason, there may follow  a few extra of these and anyway

THEY ARE ENTERTAINING.

Also I had originally included

CATEGORY 7

as a category including elements of the preceding six but as this seemed to cover most of them I left it out.

So, a few examples in each category, which makes for hard choices given the [never ending] number available.

Under Category 1, costs on business:

A Welsh Fresh Meat Company in 1992 had to cease trading and, at a cost of £20,000, raise its ceiling by six feet.

Under the Environmental  Protection Act 1990, the Health and Safety Executive decided that petrol tanks had to be leakage tested by filling with WATER instead of INERT GAS as before. The tank is thus contaminated and huge amounts of now polluted water must be taken often long journeys and always expensively by an

"authorised contractor"

to a designated site.

LATEST! eurofacts:-5th September,2008 Hurrah for Libertas! It was reported in the Sunday Telegraph on 20th July 2008 that the Irish millionaire, Declan Ganley , has disclosed far reaching plans to give voters THROUGHOUT THE EUROPEAN UNION a REFERENDUM on the HANDOVER of POWER to BRUSSELS. He is to field more than 400 candidates in next June's  European Parliament elections in 26 countries including GREAT BRITAIN, where voters have been side -tracked by governments that have happily ratified the LISBON TREATY without any democratic input from their voters. Great Britain has 12 European Parliament constituences and will certainly be a novelty -and a huge relief -if formerly non-democratic endorsement of the EU Treaties hits the buffers!  The vehicle for Mr Ganley's initiative will be his pressure group- LIBERTAS! www.libertas.eu   -he claims to be well on his way to raising the £75 million to FUND HIS PROJECT. As the long standing critic of the way that the EU has concentrated power in Brussels, AT THE EXPENSE OF DEMOCRACY I and very many others will say "GREAT, bring it on". If Mr Ganley would welcome financial contributions from the voters in the 26 countries then he should place advertisements in their NATIONAL PAPERS. His initiative will truly put the cat amongst the pigeons for it has been all too easy for Europe's political elite to ride roughshod over their peoples.  His initiative will also present UKIP with a conundrum for it no doubt expected to do well in Europe, next June-2009, against the [TRAITOROUS TRIPARTITE CABAL] the three main political parties in our country.
