NEW EU CONSTITUTION LAID BARE AT LAST
Myths and realities of the
Treaty?
The

For a generation, the British people have been lied to by politicians of
both parties about our involvement in the European Union.
From Ted
Heath pretending that joining in the first place would help
our Fishing Industry (it destroyed it).
To hear Tony Blair’s insistence on TV’s Breakfast with Frost yesterday
that he has secured a good deal for Britain, our leaders have failed to tell
the TRUTH about the EU.
But we now have a final text of the European
Constitution, which no amount of spinning from Downing Street can obscure.
So here is a guide to its myths and realities with

National Parliaments
Myth: Ministers insist that this constitution strengthens the power of
National Parliaments to hold the EU to account.
Reality: Rubbish! Britain tried to insert a mechanism under which, if enough
national parliaments complained about an EU law, it would be scrapped. Instead, we have the grandly titled Protocol
On The Role Of National Governments.
Under it national parliaments can complain as much as they like, and THEN
the EU can ignore them. Already,
half our laws are made in Brussels. After the passing of this
constitution that proportion would soar.
European
Superstate.
Myth: Jack
Straw said yesterday that this would ‘create and confirm a Union of proud
Nation States’.
Reality: For
the first time the EU becomes a State in its OWN right, able to sign
sovereign treaties’ binding upon its member states’. [Our troops could be sent
to fight a war even if our Parliament objected – whatever they say] EU law outweighs any law enacted by the British
Parliament.
The Constitution declares that the ‘symbols of Union’ are
a flag, an anthem, a motto (United in Diversity). It adds-prematurely in Britain – that ‘the currency of the Union
shall be the Euro’. It creates a
European [Monster] State.
Foreign
Affairs:
Myth: Mr
Blair said yesterday that the Constitution ‘protects completely’ our right to
run our foreign policy.
Reality: NOT TRUE. It creates an E U Foreign
Minister who’ shall conduct the Union’s common foreign and security policy’.
Britain
will be obliged ‘actively and unreservedly’ to, support EU foreign policy in a spirit
of loyalty [does Tony Blair know what that means] and mutual solidarity
[this is hardly the word to use –but the Polish people will certainly know what
they will be missing] We will even, according to the final document, have to give up our vital
seat on the UN Security Council if the EU Foreign minister asks for it.
Defence
Myth: Mr
Blair said the constitution’ protects completely’ our right to run our defence.
Reality: Despite Britain’s attempts to have it removed, the constitution
creates a mutual defence pact within the EU –we now have an obligation to offer
Slovakia ‘aid and assistance by all means in (our) power’. This ‘common
defence’ is a dangerous threat to Nato, which the Government said it was
determined to protect.
The
constitution puts in place the building blocks for a European Army, and creates
an E U arms procurement agency, which will be used by our EU partners to prevent Britain from
buying weapons from the USA.
Charter of Rights
Myth: The
Charter of Fundamental Rights will have no legal force at all. [What not another porky!]
Reality:
It is an integral part of the EU’s New Constitution.
The
feeble legal defence introduced during the final negotiations-that the EU’s
courts will pay’ due regard’ to the ‘explanations ‘ attached to the
Charter-won’t stand a moment to a legal challenge in the federalist European
Court.
So
the Constitution creates aright to strike, as well as rights to asylum,
education, social security, housing assistance, health care and environmental
protection, all of which will be interpreted by the European Court to allow it to
dictate policy to the British Government.
Criminal Justice
Myth: Britain has not allowed the EU any further powers over criminal
justice law and has retained its veto in this area. [Not again surely-I’m
afraid so]
Reality:
The Constitution hands the EU powers to pass’ European framework laws’
that not only define criminal justice procedure across Europe, but allow
Brussels to dictate’ minimum rules concerning the definition of criminal
offences and sanctions in the areas of particularly serious crime’.
The
Government has given up its veto in these areas and replaced it with a
so-called emergency brake system, under which any State, which believes a new
EU law fundamentally infringes its national rights, can block it.
However,
this could be used only on very rare occasions-once a year at most, for each
country- so it isn’t the same as a veto at all. In addition, the constitution creates-despite British objections- a
European prosecutor who could pursue cases in the British courts.
Finally
the EU wins the power to –pass laws dictating to British police forces the
‘investigative techniques’ they must use’ in relation to the detection of
serious forms of organised crime’.
Economy and Jobs
Myth: The EU gains no new powers over the British economy.
Reality:
The EU will set up a framework for member states to coordinate their
economic policies, the first step on the road to a common EU economic policy.
Brussels
also gains the ability to pass laws dictating to us about’ workers’ health and
safety, working conditions, social security and social protection of workers’.
Once again, an emergency brake’ provides the British Government with a fig
leaf, by voters with no real comfort.
The final text also encourages the creation of European
trade unions, with a view to British workers striking in support of German
colleagues.
